The prescription-only drug Xenical (Orlistat) was the subject of a lawsuit filed by the National Association of Clinical Gastroenterology Specialists in 2014 after an appeals hearing in the U. S. District Court for the District of New Jersey.
The lawsuit alleges that the National Association of Clinical Gastroenterologists (NACG) has not provided the correct label for Xenical, and that the drug’s label for its use is not adequate to meet the requirements of the United States Food and Drug Administration’s standards for the safe and effective use of Xenical. In addition, NACG and the U. Food and Drug Administration (FDA) have issued a warning in the labeling that Xenical, like other prescription drugs, is contraindicated for patients taking certain medications.
In the suit, the U. Department of Health and Human Services (HHS) and the FDA agree that the label for Xenical is adequate to meet the FDA’s standards for the safe and effective use of the drug.
The plaintiffs allege that the FDA failed to adequately warn patients of the risks associated with the use of the drug.
The plaintiffs’ complaint is in the nature of a complaint that is not well-tended and that is not to be found in a complaint.
According to the complaint, “The complaint alleges that the defendant, the NACG, failed to adequately inform the public of the risk of the potential negative side effects associated with Xenical use, including serious adverse events, in patients taking Xenical or similar weight-loss drugs.”
The defendants allege that the agency failed to provide adequate warnings to consumers about the potential dangers of Xenical and that the agency failed to advise consumers about the potential adverse effects of Xenical.
The plaintiffs allege that the FDA failed to warn consumers that the risk of Xenical use is significantly lower than other weight-loss medications that have been prescribed for weight loss. They allege that the agency failed to provide consumers with adequate warning letters and that, in the absence of such letters and warnings, consumers who took Xenical could be expected to experience the greatest adverse events.
The plaintiffs seek a preliminary injunction against the defendants from the U.

The motion for summary judgment is also granted in favor of the defendants and is otherwise granted.
